Measurement Accuracy Policy

    This Measurement Accuracy Policy ("Policy") establishes the procedures, responsibilities, and requirements relating to measurements used for quotations, manufacturing, fabrication, ordering, and installation of products supplied by Deluxe Smart Film Corp ("Company," "we," "our," or "us").

    Because many of our products are custom-manufactured to exact dimensions, accurate measurements are critical. Even small measurement errors can result in products that cannot be installed, may not function properly, or require complete replacement.

    This Policy forms part of the legally binding agreement between the Company and the Customer and should be read together with our Terms of Sale, Installation Terms & Conditions, Warranty Policy, Refund & Cancellation Policy, Shipping Policy, Website Terms & Conditions, Privacy Policy, and all other applicable Company policies.

    1. Definitions

    Measurements means all dimensions, specifications, drawings, templates, field measurements, digital scans, architectural plans, CAD drawings, sketches, or other sizing information used to manufacture or install Products.

    Products include Smart Glass, PDLC Smart Film, Decorative Privacy Film, Solar Control Film, Safety & Security Film, controllers, transformers, accessories, and related products.

    Customer Measurements means any dimensions supplied by the Customer, contractor, architect, designer, builder, engineer, or any third party acting on the Customer's behalf.

    2. Purpose

    The purpose of this Policy is to establish clear responsibilities regarding measurements used for custom-manufactured products and to reduce delays, disputes, unnecessary production costs, and installation issues resulting from inaccurate dimensions.

    3. Scope

    This Policy applies to all: Residential Projects, Commercial Projects, Product-Only Orders, Installed Projects, Smart Glass, Smart Film, Decorative Film, Solar Control Film, Safety & Security Film, Replacement Products, Warranty Replacements, Wholesale Orders, Dealer Orders, and Custom Manufacturing.

    4. Company Measurements

    When Deluxe Smart Film Corp performs an on-site measurement service, the Company will use commercially reasonable care to obtain accurate field measurements based upon the conditions existing at the time of the site visit. Company measurements are based solely on visible and reasonably accessible conditions during the inspection.

    The Company is not responsible for changes occurring after measurements are taken, including: New framing, Window replacement, Structural movement, Remodeling, Glass replacement, Design changes, Building settlement, Damage caused by other contractors, and Customer modifications. If site conditions change after measurements are completed, additional measurements may be required.

    5. Customer-Provided Measurements

    Customers may provide their own measurements for quotation or manufacturing purposes. When Customer Measurements are used: The Customer accepts full responsibility for their accuracy. Deluxe Smart Film Corp assumes no responsibility for measurement errors unless expressly agreed in writing. Products manufactured from Customer Measurements are considered custom products. Incorrect Customer Measurements may require complete remanufacturing at the Customer's expense.

    6. Preliminary Estimates

    Measurements submitted through: Website forms, Email, Telephone, SMS, Social media, Online estimators, AI assistants, Photographs, and Architectural plans are used solely for preliminary estimates unless otherwise confirmed in writing. Final pricing may change following an official site measurement.

    7. Final Site Verification

    For Company-installed projects, Deluxe Smart Film Corp reserves the right to perform a final field verification before manufacturing begins. Production may be delayed until measurements have been confirmed. Failure to allow site verification may result in cancellation of installation services or limitation of warranty coverage.

    8. Manufacturing Tolerances

    All custom-manufactured products are produced within accepted industry manufacturing tolerances. Minor dimensional variations that fall within normal manufacturing tolerances do not constitute defects. Such tolerances may result from: Manufacturing processes, Material expansion, Material contraction, Cutting equipment, Glass fabrication, Film manufacturing, and Industry standards.

    9. Glass Size Variations

    Existing glass panels may vary slightly in size even when installed within the same opening. Customers acknowledge that: Individual panes may not be identical, Manufacturing tolerances vary, Buildings settle over time, and Existing installations may not be perfectly square, level, or plumb. Products are manufactured according to approved measurements rather than assumed dimensions.

    10. Existing Conditions

    The Company is not responsible for measurement discrepancies caused by: Out-of-square openings, Bent frames, Damaged frames, Building settlement, Existing glass defects, Structural movement, Hidden damage, Water intrusion, Previous repairs, and Improper original construction.

    11. Customer Responsibilities

    Customers agree to: Provide accurate project information, Notify the Company of any construction changes, Disclose pending renovations, Allow reasonable site access, Review quotations carefully, Review measurement drawings, Confirm dimensions before approving production, Notify the Company immediately of suspected errors, and Ensure architectural drawings provided are the latest approved revision.

    12. Change Orders

    Any modification to approved measurements after manufacturing begins constitutes a Change Order. Change Orders may result in: Additional manufacturing costs, Material replacement, Revised installation dates, Storage charges, Additional labor charges, and New shipping charges. Verbal changes are not binding unless confirmed in writing.

    13. Incorrect Measurements

    Company Error

    If the error resulted solely from the Company's field measurements, Deluxe Smart Film Corp will, at its sole discretion: Remanufacture the affected product, Repair the product if feasible, Replace the affected product, or Adjust the installation where reasonably possible. These remedies constitute the Customer's exclusive remedy.

    Customer Error

    If products were manufactured using Customer Measurements that are incorrect: Replacement products will be treated as a new order, Additional manufacturing charges shall apply, Additional shipping charges may apply, and Additional installation charges may apply.

    14. Measurement Verification Process

    The Company may use one or more of the following methods: Laser measuring devices, Tape measurements, Digital templates, CAD drawings, Site inspections, Photographs, Engineering drawings, Architectural plans, Customer confirmation, and Digital measurement software. The Company reserves the right to determine the most appropriate verification method.

    15. Measurement Approval

    Before production begins, Customers may be asked to approve: Final dimensions, Product layouts, Glass orientation, Electrical locations, Wiring routes, Product specifications, Drawings, and Shop drawings. Once approved, manufacturing may begin. Subsequent changes may require complete remanufacturing.

    16. Product Compatibility

    Measurement approval does not guarantee compatibility with: Existing electrical systems, Existing glazing systems, Existing framing, Existing hardware, and Existing building conditions. Compatibility remains subject to final inspection.

    17. Re-Measurement Requirements

    Additional measurements may be required if: Construction is delayed, Windows are replaced, Frames are modified, Structural work occurs, Glass is replaced, The project is postponed for more than ninety (90) days, or The Company reasonably believes site conditions have changed. Additional service charges may apply.

    18. Commercial Projects

    Commercial customers are responsible for ensuring that: Final architectural drawings are approved, Field dimensions are coordinated among trades, Site access is available, and Approved shop drawings are reviewed before manufacturing. The Company is not responsible for errors contained in architectural drawings prepared by others unless expressly agreed in writing.

    19. Remodel & Renovation Projects

    Projects involving remodeling, renovations, additions, or reconstruction present increased measurement risks. Customers agree that: Measurements may require multiple site visits, Manufacturing may be delayed pending project completion, and Final measurements should not be taken until openings are complete and stable.

    20. Installation Limitations

    Minor field adjustments may be possible during installation. However, custom-manufactured products cannot typically be resized after fabrication. If a Product cannot be installed because of incorrect dimensions, the Customer may be responsible for replacement costs unless the error resulted solely from the Company's approved field measurements.

    21–30. Legal & Administrative

    • Limitation of Liability: To the fullest extent permitted by law, Deluxe Smart Film Corp shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from measurement errors, project delays, redesign costs, lost profits, business interruption, or related losses. The Company's total liability shall not exceed the amount paid for the specific Product directly affected by the measurement error.
    • Fraud Prevention: The Company reserves the right to reject measurements, drawings, or documentation that appear altered, inaccurate, fraudulent, or inconsistent. Knowingly providing false measurements or falsified plans may result in cancellation of the order and recovery of damages permitted by law.
    • Reservation of Rights: Deluxe Smart Film® Corp reserves the right to: Verify any measurements, Delay manufacturing pending verification, Decline manufacturing where measurements appear unreliable, Require additional site visits, and Modify production schedules when necessary.
    • Force Majeure: The Company shall not be responsible for delays in measuring, manufacturing, or installation resulting from weather events, natural disasters, labor shortages, transportation delays, utility failures, governmental actions, pandemics, cyber incidents, or any other event beyond its reasonable control.
    • Governing Law: This Policy shall be governed by the laws of the State of Florida. Exclusive venue for any dispute shall be the state or federal courts located in Miami-Dade County, Florida, unless otherwise required by applicable law.
    • Severability: If any provision of this Policy is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
    • No Waiver: Failure by the Company to enforce any provision shall not constitute a waiver of that provision or any other provision.
    • Assignment: Customers may not assign their rights or obligations under this Policy without the Company's prior written consent. The Company may assign its rights or obligations to an affiliate, successor, or purchaser of substantially all of its assets.
    • Survival: The provisions relating to payment obligations, limitation of liability, measurement approval, dispute resolution, governing law, fraud prevention, and any obligations intended by their nature to survive shall remain effective after completion of the project.
    • Changes to this Policy: Deluxe Smart Film Corp reserves the right to modify this Policy at any time. Revisions become effective upon publication unless otherwise required by law.

    Entire Agreement: This Measurement Accuracy Policy, together with the Company's proposal, approved shop drawings (if applicable), Terms of Sale, Installation Terms & Conditions, Warranty Policy, and all related policies incorporated by reference, constitutes the complete and exclusive agreement regarding measurements used in the manufacture and installation of Products supplied by Deluxe Smart Film Corp. In the event of any conflict between prior oral discussions and this Policy, this written Policy shall govern to the fullest extent permitted by applicable law.
