1. Scope
This Policy applies to shipments of: Smart Glass, Smart Film, Decorative Privacy Film, Solar Control Film, Safety & Security Film, Electrical Components, Controllers, Transformers, Accessories, Replacement Parts, Wholesale Orders, Dealer Orders, Commercial Orders, and Residential Orders.
2. Shipping Availability
Deluxe Smart Film Corp ships products throughout the United States and, where legally permitted, to select international destinations.
Shipping availability may vary depending on: Product type, Destination, Export regulations, Carrier availability, Manufacturer restrictions, and Applicable laws.
The Company reserves the right to decline shipments to locations where delivery is prohibited, impractical, or presents an unreasonable risk.
3. Processing Times
Order processing generally begins after: Full payment or required deposit has been received; Measurements, specifications, and order details have been approved; All required documentation has been provided; and Production has been scheduled, where applicable.
Custom-manufactured products typically require additional production time before shipment. Processing times are estimates only and are not guaranteed unless expressly stated in writing.
4. Estimated Shipping Times
Estimated shipping and delivery dates are provided for convenience only. Actual shipping times may vary due to: Manufacturing schedules, Material availability, Carrier delays, Weather conditions, Customs processing, Holidays, Labor shortages, Transportation disruptions, and Other unforeseen circumstances.
Unless expressly agreed in writing, estimated delivery dates do not constitute guaranteed delivery commitments.
5. Shipping Methods
The Company may utilize one or more shipping methods depending on the size, weight, value, and destination of the order, including: Ground shipping, Freight carriers, Less-Than-Truckload (LTL), Full Truckload (FTL), White-glove delivery, Local courier services, International freight forwarding, and Expedited shipping (when available).
The Company reserves the right to determine the most appropriate shipping method unless otherwise agreed in writing.
6. Shipping Charges
Shipping charges are calculated based on factors including: Product dimensions, Weight, Packaging requirements, Shipping destination, Freight classification, Insurance, Fuel surcharges, Carrier rates, and Special handling requirements.
Shipping charges are disclosed during the quotation or ordering process whenever reasonably practicable. Shipping charges are generally non-refundable once products have been shipped.
7. Delivery Requirements
Customers are responsible for ensuring that: The shipping address is complete and accurate, Someone authorized is available to receive the shipment when required, The delivery location is reasonably accessible, and Any required permits, building access, loading docks, elevators, or site access arrangements have been made before delivery.
Additional charges resulting from missed deliveries, inaccessible locations, storage fees, redelivery attempts, or special handling requested by the customer may be the customer's responsibility.
8. Risk of Loss
Unless otherwise agreed in writing, risk of loss and title to shipped products transfer to the customer upon delivery of the products to the shipping carrier.
For Company-installed products, risk of loss transfers upon substantial completion of the installation unless otherwise required by applicable law.
Customers are encouraged to obtain appropriate insurance for valuable shipments.
9. Inspection Upon Delivery
Customers should inspect all shipments immediately upon delivery. Before signing any delivery receipt, customers should verify: Quantity, Packaging condition, Visible damage, Correct products, and Missing items.
If damage is visible, customers should: Note the damage on the carrier's delivery receipt, Photograph the shipment and packaging, Retain all packaging materials, and Notify both the carrier and Deluxe Smart Film Corp as soon as reasonably possible.
Failure to inspect shipments promptly may affect available remedies to the extent permitted by law.
10. Shipping Damage
If products are damaged during shipment: Notify the shipping carrier immediately, Notify Deluxe Smart Film Corp within five (5) business days after delivery, Preserve all packaging materials, Provide photographs of the damage, and Cooperate with any carrier inspection or claims process.
The Company will reasonably assist customers with shipping claims but is not responsible for damage occurring after risk of loss has transferred, except where otherwise required by law or expressly agreed in writing.
11. Incorrect Shipping Information
Customers are solely responsible for providing accurate shipping information. The Company is not responsible for delays, additional charges, or failed deliveries resulting from: Incorrect addresses, Incomplete addresses, Incorrect ZIP codes, Incorrect recipient information, or Failure to notify us of address changes before shipment.
Any additional shipping, storage, rerouting, or redelivery costs resulting from inaccurate information may be charged to the customer.
12. Failed Delivery Attempts
If a shipment cannot be delivered due to customer-related reasons, including the absence of an authorized recipient, refusal of delivery, or inability to access the delivery location, the carrier may: Attempt redelivery, Return the shipment to the Company, Store the shipment, or Charge additional handling or storage fees.
The customer is responsible for any additional costs associated with failed delivery attempts when caused by the customer's actions or omissions.
13. International Shipments
International shipments may be subject to: Import regulations, Customs inspections, Export restrictions, Local product requirements, Carrier limitations, and Government approvals.
Customers are responsible for ensuring that products may be legally imported into their destination country. The Company does not guarantee that products comply with the laws or regulations of every jurisdiction.
14. Customs, Duties & Taxes
Unless expressly agreed otherwise in writing, customers are responsible for all: Customs duties, Import taxes, Value-added taxes (VAT), Brokerage fees, Clearance fees, Government charges, Local taxes, and Import permits.
Failure to pay required customs charges may result in shipment delays, storage fees, return shipments, or abandonment of the shipment.
15. Delays Beyond Our Control
Deluxe Smart Film Corp shall not be liable for shipping or delivery delays caused by circumstances beyond its reasonable control, including but not limited to: Severe weather, Hurricanes, Floods, Fires, Earthquakes, Labor disputes, Carrier delays, Supply chain disruptions, Port congestion, Customs delays, Government actions, Pandemics, Cybersecurity incidents, Utility outages, Acts of war, Civil unrest, Terrorism, and Force majeure events.
Estimated shipping dates shall automatically extend for the duration of any such event.
16. Partial Shipments
The Company reserves the right to ship products in multiple shipments when necessary due to inventory availability, production schedules, carrier limitations, or operational requirements. Partial shipments do not constitute a breach of contract.
17. Lost Packages
If a shipment is believed to be lost: Customers should notify Deluxe Smart Film Corp promptly. The Company will reasonably assist in initiating a carrier investigation. Replacement products or refunds, if applicable, will be determined after completion of the carrier's investigation and in accordance with applicable law and the Company's related policies.
18. Product Storage
If the customer requests delayed shipment or is unable to receive products after they are ready for delivery, the Company may, at its discretion: Store the products for a reasonable period, Assess reasonable storage fees, Require payment in full before release of the products, or Arrange delivery at a later mutually agreed date.
The Company is not responsible for delays caused by customer-requested storage.
19. Changes to This Policy
Deluxe Smart Film Corp reserves the right to modify this Shipping Policy at any time. Changes become effective immediately upon posting the revised Policy on our Website unless otherwise required by applicable law. The "Last Updated" date at the beginning of this Policy reflects the latest revision.
